Katie AI Receptionist — Terms of Service

1. Service Katie is an AI receptionist that answers business calls, collects caller details (name, phone number, service), checks availability, and books appointments. A NEAT SPACE AI team member calls the client back to confirm each booking.

2. Plans & Pricing (AUD)

Prices are in Australian dollars and exclude GST. Pricing is as set out on our website and may change with 30 days notice via email.

3. Free Trial A 30-day free trial is available. Limited signups. No payment method required during the trial. After 30 days, the free trial ends and the AI receptionist will stop answering calls. To continue using the service, sign up for a paid plan.

4. Payment Billed monthly via Stripe. Payment is due at the start of each billing cycle. Failed payments will be retried automatically. After 3 failed attempts, the service will be paused until payment is received.

5. Cancellation Cancel anytime by emailing **ai@neatspace.com.au**. Cancellation takes effect at the end of the current billing period. No refunds for partial months. No lock-in contracts. After cancellation, the AI receptionist will stop answering calls at the end of the billing period.

Phone numbers assigned to the client remain the property of NEAT SPACE AI and may be retained for future clients. Porting requests must be made at least 14 days before cancellation.

6. Client Responsibilities
• Provide accurate business hours and days of operation during onboarding, and notify NEAT SPACE AI of any changes
• Respond to team callback requests within 48 hours. NEAT SPACE AI facilitates the callback request but is not responsible for the timeliness or quality of the client's response
• Inform NEAT SPACE AI of any changes to services offered or contact details
• NEAT SPACE AI is not liable for scheduling conflicts caused by incorrect or outdated availability information provided by the client

7. Limitation of Liability

- **AI Acknowledgment.** Katie is an AI-powered assistant. She may occasionally misunderstand callers, misinterpret requests, or produce incorrect outputs. The Client acknowledges that AI is not perfect and agrees to verify all critical information.

- **No Consequential Damages.** To the maximum extent permitted by law, NEAT SPACE AI shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to lost profits, lost revenue, lost business opportunities, or damage to reputation arising from the use or inability to use the Service.

- **Technical Limitations.** NEAT SPACE AI is not liable for missed calls, misdirected calls, or service interruptions caused by: technical outages, internet failures, third-party service disruptions (Twilio, ElevenLabs, Google, AWS), power outages, natural disasters, war, strikes, or any event outside NEAT SPACE AI's reasonable control.

- **Liability Cap.** NEAT SPACE AI's total liability for any claim arising from or related to the Service is limited to the greater of (i) $100 AUD, or (ii) the total amount paid by the Client for the Service in the 12 months preceding the claim.

- **Client Indemnification.** The Client agrees to defend, indemnify, and hold harmless NEAT SPACE AI from any claims, damages, or expenses (including legal fees) arising from: (a) the Client's use of the Service in violation of these Terms, (b) the Client's violation of any applicable law, or (c) any third-party claim related to the Client's business operations.

- **Data Breach Notification.** In the event of a data breach involving client or caller information, NEAT SPACE AI will notify affected clients within 72 hours and take reasonable steps to mitigate the impact.

- **Service Provided "As Is."** THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8. Privacy
• Caller information (name, phone number, service requested, issue description) is collected only for the purpose of providing the service
• Data is stored securely on Australian servers
• Data is not sold, shared, or used for any purpose other than providing the service
• Call recordings are not stored
• Call session data is held temporarily in server memory during the call and is automatically deleted within 1 hour after the call ends
• Wrong number calls are not logged — no data is collected from misdialled calls
• Client may request deletion of their data at any time by emailing ai@neatspace.com.au

9. Fair Usage Policy
• Each plan includes a monthly call volume limit based on typical usage for a small business: - **Starter ($99/mo):** Up to 200 calls per month - **Pro ($199/mo):** Up to 500 calls per month - **Enterprise (Custom):** Custom call volume agreed at signup
• Calls are limited to 10 minutes. Calls exceeding this limit may be ended. Excessive call duration may count toward usage limits
• If a client exceeds their plan's call volume in a billing month, NEAT SPACE AI will: - Notify the client via email - Offer an upgrade to the next plan tier - If no upgrade is accepted within 7 days, service will be paused until the next billing cycle
• NEAT SPACE AI reserves the right to move a client to a higher plan tier if usage exceeds plan limits for two consecutive months
• Call volume is calculated based on inbound calls answered by the AI receptionist

10. Service Suspension
• NEAT SPACE AI may suspend service immediately if: - Payment is 14 days overdue after the due date - The client exceeds their plan limits and does not upgrade after notice - The platform is used for illegal, fraudulent, or abusive activity
• Suspended accounts can be reinstated once the issue is resolved
• Client data is retained for 30 days after suspension in case of re-activation. After 30 days, client data will be permanently deleted

11. Setup & Support
• Target setup time: 48 hours after receiving all required information from the client
• Support requests responded to within 24 hours during business days

12. Changes to Terms NEAT SPACE AI may update these terms with 30 days notice via email. Continued use of the service after changes take effect constitutes acceptance.

13. Governing Law These terms are governed by the laws of the Australian Capital Territory
